Participants in an Appeal

      The primary participants in the appeal process are:
  • The APPELLANT: the person or organization appealing the decision. The appellant must have previously commented on or expressed interest in the action being appealed.
  • The RESPONSIBLE OFFICIAL: the Forest Service official who made the decision - for example, approves a timber sale - that can be appealed.
  • The APPEAL REVIEWING OFFICER: the Forest Service official who reviews the appeal and makes a recommendation to the Appeal Deciding Officer.
  • The APPEAL DECIDING OFFICER: the Forest Service official who rules on the appeal.
  • The INTERESTED PARTY: any person or organization that submits written comments on the appeal (including timber companies).

Necessary Components of an Appeal

     

  • A statement the document is a Notice of Appeal filed pursuant to 36 CFR Part 215.
  • The Appellant's name, address and telephone number.
  • The title and subject of the decision document, the date of the decision, and the name and title of the Responsible Official.
  • The specific change(s) in the decision the appellant seeks, or portion of the decision to which appellant objects.
  • An explanation of how the Responsible Official's decision fails to consider comments previously provided and how appellant believes the decision violates law, regulation, or policy.

Note * There is no need to request a Stay of Implementation. This is automatic under 36 CFR 215.
